Terms and Conditions

These are the standard terms and conditions for Playways Day Nursery we believe they reflect the custom and practice of all private day nurseries providing full day care. We have included the conditions regarding payment and notice periods to help promote stability, assist forward planning and enable proper resourcing of the nursery. These terms and conditions do not affect the Parent/Guardian's statutory rights.

All fees are charged monthly in advance and must be paid by cheque, bank transfer or direct debit on the first day of the month to which they relate. Fees will be invoiced to the person(s) named on the registration form. Fees are still payable during periods of absence from the nursery, including sickness and holidays. When calculating the fees we have taken into account all bank holidays and the period the nursery is closed over the Christmas period so as to reflect equal monthly amounts over the year. Children move from one age band to another on the 1st of the month following their birthday.

Fees are reviewed annually and are subject to increase parents/guardians will be given notification of any fee increase and the new fee structure will become effective one month after such notification.

Parent's/Guardian's wishing to surrender their child's place(s) at the nursery must give two month's written notice or pay the equivalent of two month's fees for the place(s).

Two month's written notice is also required if a parent/guardian wishes to increase/decrease days attended if two month's notice is not received the parent/guardian will still be invoiced at the old rate until two month's have expired. The effective date in both cases shall be the date notice is received at the nursery.

Playways limited reserves the right to charge interest on late fees at the rate of 3% above Barclays Bank rate. Unpaid cheques are subject to a £10 administration charge.

Playways Limited does not accept responsibility for accidental injury or loss of property. Playways Limited does maintain those insurances as required by law.

Details of these are available from the nursery manager. Copies of the current employer's liability and public liability insurance policies are displayed on the nursery notice board.


Force Majeure

Playways Limited cannot be held liable for the withdrawal of a place due to third party action this will include closure due to war, strike, riot, crime, flooding, earthquake, storm, power failure etc.

Where a member of staff, within six months of leaving the employment of Playways Limited, is employed by a parent/guardian to care for their child, who was previously registered at Playways Day Nursery, then the parent/guardian will be liable to pay Playways Limited a sum equivalent to six month's salary for the employee at the time their employment with Playways was terminated.

To secure a place at Playways Day Nursery a non refundable deposit of one month's fees must be paid at the time the place is confirmed by the parent/guardian. Once a place at the nursery is confirmed two month's written notice is required if you wish to withdraw your child from the nursery.

For maximum security for your child, it is a requirement that you sign your child on our attendance sheet an arrival and out again on collection. Where parents/guardians are arranging for other people to collect their children you should notify the person in charge as soon as possible giving as much information as possible including a password to be used when arriving at the nursery. If possible it would help if the person to be collecting the child could visit the nursery with the parent/guardian in advance so as to be introduced to the staff.

Please note: If someone comes to collect your child and we do not have the authority, either on file or by your telephone call on that day, this may lead to delays in handing over your child whilst checks are made.

If your child becomes ill whilst at nursery the person in charge will contact the parent/guardian or emergency contact indicated on the child's information form.

If your child is suffering from a communicable disease your child should not be brought to nursery until such time as the infection is cleared. The nursery will not be responsible for any communicable disease transmitted at nursery.

Playways Limited is only able to administer medication specifically prescribed for the child by a qualified medical practitioner.

We will work together with parents/guardians to provide suitable food for children who have a special dietary requirement.

It is understood that Playways Limited is under an obligation to report to OFSTED/Child Protection any incident where we consider a child may have been abused or neglected. This may be done without informing the parent/guardian.

 

These terms and conditions are liable to change from time to time. Any changes will be given in writing and will become effective one month after such notification.

 

Data protection

 

It is a legal requirement on the nursery to hold information about children using the nursery and its staff. Basic information is used for registers, invoices and for emergency contacts; however, all records will be stored in a locked office.

 

Legal contract

 

The offer of a place and its acceptance by the parents gives rise to a legally binding contract on the terms of these terms and conditions.

 

These terms and conditions are governed exclusively by English and Scottish law.
